We provide legal consultations for the purpose of analyzing our
clients' business practices, finding the lawsuits waiting to happen,
designing practical changes in policies and procedures that will
limit the likelihood of litigation, and helping to implement the
changes. Nobody can tell your business how to avoid litigation like someone who has litigated employment cases for nearly two decades, as Ms. DeBrota has.
Our Approach
The DeBrota Law Firm LLC
approaches liability avoidance in three ways, which can be used
in combination or alone to suit your needs:
- Audit and analyze your business to find the practices and policies
from which the most serious problems are likely to arise
- Train your executives and managers in the skills and knowledge
required to avoid employment-related problems
- Implement workable business policies and practices that keep
the solution in place and working over the long run
Legal Audits and Analysis
The DeBrota Law Firm LLC provides client-specific “legal
audits” to find the most likely areas of employment-related
problems, so we can most effectively direct our consultation services
to the areas where they are needed the most.
Typically, we review the client’s history of human resources
issues, conformity with federal overtime requirements, sexual harassment
complaint investigation procedures, how it handles ADA and FMLA
compliance, e-mail use and retention policies, record-keeping and
documentation procedures, hiring, promotion, discipline and termination
practices, among many other areas. By doing this, we are able to
identify the problems specific to each particular client.
Training
Once we have identified the most likely problem areas, we customize
an efficient management training package geared toward those areas.
Many of our training programs can be provided in CD ROM and/or web-based
formats for companies which prefer to train their managers and executives
through those means.
The training can range from a “lunch and learn” overview
of key issues, to an intensive all day management workshop. We tailor
our approach to the level and responsibilities of those being trained
to your company’s specific needs.
Our training programs are invaluable to insure compliance
with the law as interpreted in legal opinions of the United
States Supreme Court, other federal and Indiana state courts, as
well as administrative agencies like the Equal Employment Opportunity
Commission. The fact that a company expends the effort to review
its policies and procedures and implement professional training
not only helps avoid litigation, it can also potentially provide
a valuable defense to an employee lawsuit. Moreover, the failure
to properly train managers can lead to increased damage awards,
including punitive damages.
Policy, Procedure and Form Development and Implementation
We do not just train and then leave on your own. Rather, we help
our clients integrate what we have taught them into their everyday
business philosophy and activities. We are also available for situation
specific consultations as they arise.
We do this by providing our clients with user-friendly policies,
procedures, forms and “cheat sheets,” in a variety of
formats (from hard copy to electronic, depending on the client’s
needs and preferences). These materials help to limit the extent
to which executives and managers improvise their decisions in legally-sensitive
areas. We help take out the guesswork, and create workable “if
this, do that” solutions that can stop the problems before
they start, prevent their escalation or limit potential damage to
company morale and resources.
Our approach to each client is unique and customized. We invite
your inquiry regarding how The DeBrota Law Firm LLC can assist
you.
"You must be the change you wish to see in the
world."
